1. Introduction and Acceptance of Terms

Welcome to Jukadi.com ("Jukadi", "we", "us", or "our"), an international online marketplace operated by JUKADI INTERNATIONAL LIMITED, a private limited company incorporated in England and Wales under company registration number 15490740.

Jukadi provides a digital marketplace that connects travellers with independent third-party suppliers offering tours, excursions, sightseeing activities, cultural experiences, adventure activities, water sports, boat rentals, yacht charters, transportation services, attractions, and other travel-related experiences worldwide.

These Terms and Conditions ("Terms") govern access to and use of the Jukadi website, its associated services, and the booking facilities made available through the Platform.

By accessing or using the Platform, registering an account, submitting a booking request, or completing a purchase, you agree to comply with these Terms to the extent applicable to your use.

Before confirming a booking, you must review the relevant experience description, pricing, cancellation conditions, supplier information, and any additional terms specifically applicable to that booking.

Where required by applicable law, Jukadi will obtain your express agreement to these Terms before entering into a contract.

If you do not agree with these Terms, you should not create an account or make a booking through the Platform.

Nothing in these Terms is intended to exclude, restrict, or diminish any mandatory consumer rights or protections granted under applicable law.

2. Definitions

For the purposes of these Terms:

"Jukadi" or "Company" means JUKADI INTERNATIONAL LIMITED, the company operating the online marketplace.

"Platform" means Jukadi.com, its websites, mobile interfaces, applications, booking systems, and related digital services.

"User" means any person accessing, browsing, registering, or otherwise using the Platform.

"Customer" or "Traveller" means any individual who books, purchases, or participates in an Experience offered through the Platform.

"Supplier" or "Service Provider" means an independent third-party business, tour operator, attraction operator, transportation company, boat operator, activity organiser, or other professional service provider offering Experiences through Jukadi.

"Experience" means any tour, activity, excursion, attraction, transfer, rental, or other travel-related service listed on the Platform.

"Booking" means a reservation or purchase request made through the Platform for a specific Experience.

"Booking Confirmation" means an electronic notification confirming that a Booking has been accepted in accordance with its applicable conditions.

"Experience Conditions" means the specific terms, restrictions, cancellation rules, requirements, and other information applicable to an individual Experience.

"Applicable Law" means the laws, regulations, and mandatory legal requirements relevant to the Platform, the parties, and the services concerned.

3. Nature of the Jukadi Marketplace

Jukadi operates primarily as an online intermediary marketplace.

The Platform allows independent Suppliers to advertise, promote, and offer Experiences to Customers across multiple countries and destinations.

Unless expressly identified otherwise during the booking process, Jukadi does not own, manage, or directly operate the Experiences listed on the Platform.

Suppliers independently organise and deliver their Experiences using their own personnel, vehicles, vessels, equipment, facilities, and operational resources.

For ordinary marketplace bookings, the contract for performing the Experience is entered into between the Customer and the relevant Supplier.

Jukadi facilitates the discovery, presentation, booking, communication, payment collection where applicable, and administration of these services.

Jukadi may provide additional customer assistance, booking support, marketing, verification procedures, and dispute-resolution assistance.

These services do not, by themselves, make Jukadi the operator of an Experience.

However, where Jukadi is expressly identified as the direct contracting service provider, package organiser, or otherwise has responsibilities imposed by applicable law, the relevant legal obligations will apply notwithstanding anything else in these Terms.

The legal relationship between Jukadi and each Supplier is separately governed by the relevant supplier partnership agreement.

4. Independent Supplier Status and Responsibilities

Suppliers offering Experiences through Jukadi operate as independent businesses.

Each Supplier is responsible for performing the services it offers and for complying with the legal requirements applicable to its operations.

Subject to applicable law, Suppliers are responsible for:

  • Holding the licences, permits, registrations, and authorisations required for their services.

  • Maintaining appropriate insurance where required by law or the applicable supplier agreement.

  • Providing accurate service descriptions, prices, schedules, availability, restrictions, and inclusions.

  • Delivering confirmed Experiences in accordance with the agreed Booking Conditions.

  • Complying with applicable health, safety, maritime, aviation, transportation, tourism, and consumer protection regulations.

  • Employing or engaging suitably qualified personnel, guides, drivers, instructors, and operators.

  • Maintaining appropriate safety equipment and operational procedures.

  • Informing Customers about material changes, restrictions, and safety requirements.

  • Handling operational incidents and cooperating with lawful complaints and investigations.

Jukadi may require Suppliers to complete identity, business, or documentation checks before or during their participation on the Platform.

Jukadi may review, suspend, restrict, or remove Suppliers who fail to satisfy its marketplace requirements.

Such actions do not replace the Supplier's responsibility to comply with applicable laws.

Jukadi does not guarantee that every Supplier or Experience will be error-free, risk-free, or suitable for every Traveller.

Nothing in this section excludes any duty or liability that Jukadi itself has under applicable law.

5. Supplier Verification and Verified Status

Jukadi may operate a supplier verification programme intended to improve marketplace transparency and identify participating businesses.

Suppliers may be asked to provide documents such as business registration certificates, tourism licences, identity documents, operating permits, insurance information, and payment details.

Where applicable, a Supplier may receive a Verified badge following the completion of Jukadi's verification procedures.

A Verified badge indicates that the Supplier has completed the verification checks applicable at the time of review.

It does not constitute a guarantee of future performance, regulatory compliance at all times, customer satisfaction, or the absence of operational risks.

Jukadi reserves the right to request updated documentation, conduct additional checks, suspend verification status, or remove a Supplier from the Platform where justified.

Verification procedures do not transfer operational control or legal responsibility for an Experience from the Supplier to Jukadi.

6. Eligibility and Account Registration

Customers submitting Bookings must be at least 18 years old and legally capable of entering into binding contracts, unless applicable law expressly permits otherwise.

Individuals under 18 may participate in eligible Experiences when accompanied or authorised by a parent, guardian, or responsible adult in accordance with the Supplier's conditions and local law.

Customers must provide accurate, complete, and current information when registering an account or making a Booking.

Users are responsible for maintaining the confidentiality of their account credentials and for notifying Jukadi promptly if they suspect unauthorised access.

Customers must not:

  • Create accounts using false or misleading identities.

  • Submit fraudulent or unauthorised Bookings.

  • Use payment methods without proper authorisation.

  • Interfere with Platform security or functionality.

  • Attempt to gain unauthorised access to accounts or systems.

  • Engage in harassment, fraud, unlawful conduct, or misuse of the Platform.

Jukadi may restrict or suspend access where reasonably necessary to prevent fraud, protect users, comply with legal obligations, or investigate material breaches of these Terms.

Any restriction will be proportionate to the circumstances and subject to applicable law.

7. Experience Listings and Information Accuracy

Suppliers are responsible for providing accurate and up-to-date information about their Experiences.

Listings may include descriptions, photographs, prices, departure times, meeting points, transportation arrangements, included services, exclusions, accessibility information, and cancellation conditions.

Jukadi may edit, format, translate, or enhance listing content for clarity, presentation, accessibility, and search visibility.

Such editorial activity does not automatically make Jukadi the operator or principal provider of the listed Experience.

Jukadi takes reasonable steps to identify and correct material inaccuracies brought to its attention.

However, information supplied by independent Suppliers may occasionally contain errors, omissions, or outdated details.

Where a material error is identified before a Booking is confirmed, Jukadi or the Supplier may correct the information and offer the Customer the opportunity to proceed on the corrected terms or withdraw the request without an improper charge.

Material changes to a confirmed Booking will be handled in accordance with the agreed Booking Conditions and applicable consumer law.

Photographs and illustrative material should reasonably represent the advertised Experience, although weather, seasonal conditions, equipment, itineraries, and other operational details may vary.

8. Prices, Taxes, Fees, and Currency

Suppliers establish the prices of Experiences offered through the Platform, subject to their agreements with Jukadi and applicable law.

Jukadi may display prices in euros or other supported currencies depending on the Platform's functionality and the selected payment method.

The applicable transaction currency and total payable amount will be displayed before the Customer confirms payment.

Currency conversions shown for information or comparison purposes may be approximate.

Banks and payment providers may apply their own exchange rates or international transaction charges.

Jukadi is not responsible for independently imposed currency-conversion charges from a Customer's bank or payment provider, except where applicable law provides otherwise.

Mandatory taxes and unavoidable charges that can reasonably be calculated in advance will be included in the displayed total price in accordance with applicable pricing laws.

Where a mandatory charge cannot reasonably be calculated in advance, the existence of that charge and the method used to calculate it will be clearly disclosed before Booking.

Optional extras, upgrades, and additional services must be identified separately and must not be added without the Customer's agreement.

Examples may include optional transportation upgrades, additional equipment, premium services, or separately purchased products.

Prices may change before Booking confirmation.

Once a Booking has been confirmed, its agreed price cannot be increased unilaterally except where a valid, clearly disclosed contractual provision and applicable law expressly permit the change.

9. Payment Processing and Collection

Jukadi may facilitate electronic payments for Experiences through authorised third-party payment service providers.

Supported payment methods depend on the options displayed during checkout and may vary by country, currency, and transaction.

Payments may be collected by Jukadi, a payment processor, or another identified collecting entity acting in the capacity disclosed or legally applicable to the transaction.

Where Jukadi collects a Booking payment on behalf of a Supplier, the relevant contractual and payment-processing arrangements govern how the funds are handled and settled.

The designation of a party as the payment recipient or merchant of record for payment processing does not, by itself, determine who is responsible for operating an Experience.

It also does not remove any statutory rights or legal obligations arising from the transaction.

Jukadi is not a bank and does not represent that customer payments are held in a regulated escrow or trust arrangement unless such an arrangement is expressly provided and disclosed.

Payments may be subject to fraud screening, security verification, card authorisation, and other reasonable checks.

Payment authorisation or successful payment processing does not necessarily mean that the Supplier has accepted the Booking.

The Customer will be informed of the applicable booking status.

Jukadi may withhold confirmation or cancel a transaction where reasonably necessary because of suspected fraud, payment failure, sanctions restrictions, unlawful activity, or other legitimate grounds.

Any funds collected for a Booking that is not accepted will be handled in accordance with the refund provisions and applicable law.

10. Booking Requests and Confirmation

A Booking request may be submitted through the Platform using the available reservation process.

The Customer must review the selected Experience, date, number of participants, price, meeting arrangements, and applicable conditions before confirming the request.

Depending on the Experience, a Booking may require acceptance by the Supplier.

The Platform may display statuses such as Pending, Confirmed, Declined, Cancelled, Unpaid, or another clearly explained status.

A pending request does not constitute a guaranteed reservation unless the applicable Booking Conditions expressly provide otherwise.

For Experiences offering instant confirmation, acceptance may occur automatically when the specified booking requirements are satisfied.

For Experiences requiring Supplier approval, the Booking becomes confirmed when the relevant acceptance conditions have been fulfilled and confirmation has been issued.

Customers should retain their Booking Confirmation and follow any instructions relating to meeting times, collection points, tickets, or identification.

Customers should not rely on an unconfirmed Booking when making separate non-refundable travel arrangements.

If a Supplier declines a request after payment has been collected, the Customer will be entitled to a refund of the amount paid for the unavailable Experience, unless a lawful alternative has been expressly accepted.

11. Customer Responsibilities

Customers are responsible for reviewing the relevant Experience Conditions before booking and participating.

Customers must provide correct information about the participants and communicate any necessary details that could materially affect the provision of the service.

Customers must comply with reasonable safety instructions issued by the Supplier.

Where appropriate, Customers should assess whether an Experience is suitable for their circumstances, including physical ability, accessibility requirements, health considerations, swimming ability, or other relevant factors.

Customers should obtain professional advice where appropriate before participating in activities involving significant physical or medical risks.

Customers must not participate in activities under the influence of substances where doing so would create a safety risk or violate the Supplier's lawful rules.

Suppliers may refuse or discontinue participation where there is a reasonable and proportionate safety concern or serious breach of disclosed participation requirements.

The consequences for payment or refunds will depend on the circumstances, applicable Booking Conditions, and mandatory consumer rights.

Nothing in this section excludes liability for a Supplier's or Jukadi's own negligence or other legally actionable conduct.

12. Cancellation by Customers

Cancellation conditions vary depending on the Experience and the policy displayed before Booking.

For Experiences expressly advertised as offering free cancellation up to 24 hours before the scheduled start time, Customers may cancel at least 24 hours in advance and receive a full refund of the eligible Booking amount paid through Jukadi.

The cancellation deadline is calculated according to the local time at the Experience's scheduled starting location, unless another time zone is clearly specified.

For Experiences with this standard policy, cancellations made less than 24 hours before the scheduled start time, including same-day cancellations or no-shows, may be non-refundable, subject to applicable law and any more favourable conditions stated in the Booking Confirmation.

Some Experiences may carry different cancellation rules because of their nature, limited availability, third-party tickets, advance permits, reserved capacity, exclusive charters, special events, or customised arrangements.

Any special cancellation policy must be clearly disclosed before the Customer completes the Booking.

Where a special policy conflicts with a general cancellation description, the clearly disclosed policy accepted for the specific Booking will apply, provided it complies with applicable law.

Jukadi will not impose undisclosed cancellation charges or deductions that are unlawful or unfair.

Any mandatory statutory right to cancel, obtain a refund, or seek another remedy remains unaffected.

For certain leisure activities, accommodation, and other date-specific services, an automatic statutory 14-day cooling-off right may not apply where the relevant legal exemption is satisfied.

Customers should therefore review the cancellation conditions attached to their particular Experience.

13. Changes and Amendments to Bookings

Customers may request changes to a confirmed Booking, including adjustments to the date, time, or number of participants.

Changes are subject to Supplier availability, operational restrictions, applicable price differences, and the conditions originally disclosed.

Submitting a modification request does not automatically guarantee approval.

Jukadi may assist with communicating amendment requests to the Supplier.

If the requested change cannot be accommodated, the original Booking Conditions will continue to apply unless the parties agree otherwise or applicable law requires another outcome.

Any additional fee must be disclosed before the Customer agrees to the modification.

Jukadi and Suppliers must not impose arbitrary or undisclosed amendment charges.

14. Cancellation or Changes by Suppliers

A Supplier may occasionally need to cancel or modify an Experience because of operational difficulties, safety concerns, severe weather, equipment failure, insufficient participation where previously disclosed, or other legitimate circumstances.

Suppliers must notify Jukadi and affected Customers as promptly as reasonably possible.

Where a Supplier cancels a confirmed Experience before providing it, the Customer will ordinarily be entitled to a full refund of the amount paid for that Experience or may voluntarily agree to a suitable alternative.

Customers are not required to accept a replacement Experience unless applicable law or the agreed conditions lawfully provide otherwise.

Where only part of an Experience is affected, the appropriate remedy will depend on the circumstances, the value of services delivered, the Booking Conditions, and applicable law.

Jukadi may assist in arranging a refund, alternative supplier, or rescheduled Experience.

However, Jukadi does not guarantee availability of a replacement service.

Expenses incurred independently by the Customer, such as flights or unrelated accommodation, are not automatically reimbursable by Jukadi solely because a Supplier cancels an Experience.

This does not exclude any liability or remedy that applies under mandatory law or arises from a breach for which Jukadi is legally responsible.

15. Refunds and Reimbursements

Refund eligibility is determined by the applicable Booking Conditions, the circumstances of the cancellation or service failure, and relevant consumer protection laws.

Where Jukadi is responsible for administering an eligible refund, it will initiate the refund without undue delay and within any applicable statutory deadline.

The actual time required for the funds to appear in the Customer's account may depend on the bank, card issuer, payment network, and payment processor.

Refunds will normally be made to the original payment method where technically possible and legally appropriate.

Alternative refund methods may be used where necessary, lawful, and suitably agreed.

Refunds will normally be calculated in the original transaction currency.

Any exchange-rate difference caused by conversion performed by a financial institution may affect the equivalent amount received in another currency.

Jukadi will not apply undisclosed or unlawful refund-processing fees.

Where a cancellation charge is legally permitted and was properly disclosed, the relevant deduction will be explained to the Customer.

A Customer is not required to accept non-cash credit, vouchers, or wallet balances instead of a monetary refund where applicable law provides a right to monetary reimbursement.

Where the payment was made directly to a Supplier rather than through Jukadi, the relevant Supplier or payment recipient will normally administer the refund, without prejudice to any separate legal responsibility of Jukadi.

16. No-Shows, Late Arrivals, and Missed Activities

Customers are responsible for arriving at the correct meeting point at the specified time.

Suppliers may be unable to delay departures or extend scheduled activities for late-arriving participants.

A failure to attend an Experience may be treated as a no-show under the disclosed cancellation conditions.

Customers should contact the Supplier or Jukadi as soon as possible if they anticipate a delay.

If a Customer misses an Experience because of circumstances within their own control, a refund may not be available.

Where the Supplier fails to provide clear or accurate meeting instructions, changes the departure details without proper notice, or otherwise causes the failure of the Experience, the Customer's entitlement to a remedy will be assessed according to applicable law and the relevant contractual obligations.

17. Health, Safety, and Adventure Activities

Certain Experiences involve inherent risks associated with travel, physical activities, vehicles, vessels, water, weather, animals, heights, or unfamiliar environments.

Customers must review all material safety information and participation requirements before making a Booking.

Suppliers are responsible for implementing the safety measures required by applicable law and for giving appropriate instructions to participants.

Customers should follow lawful and reasonable safety directions and use equipment as instructed.

Activities such as diving, snorkelling, sailing, desert safaris, hiking, and other adventure experiences may require additional precautions or qualifications.

Customers should disclose information necessary for the safe provision of an Experience where reasonably requested and lawfully processed.

Jukadi recommends that Customers obtain appropriate travel, medical, accident, or cancellation insurance suitable for the destination and selected activities.

Unless expressly stated otherwise, purchasing an Experience through Jukadi does not automatically include comprehensive personal travel insurance.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.

18. Weather, Force Majeure, and Extraordinary Circumstances

The performance of Experiences may be affected by events beyond the reasonable control of Jukadi or the relevant Supplier.

Such events may include natural disasters, severe weather, government restrictions, armed conflict, civil unrest, public health emergencies, transport disruption, unexpected closures, and other extraordinary circumstances.

Where such an event makes an Experience unsafe, unlawful, or impossible to perform, the Supplier may need to modify, postpone, or cancel it.

Jukadi will use reasonable efforts to assist Customers and Suppliers in communicating available options.

Neither Jukadi nor the relevant Supplier will be responsible for failures or delays to the extent that liability is lawfully excluded because the event was genuinely beyond their reasonable control.

However, force majeure does not automatically extinguish a Customer's right to a refund, repayment, or other remedy where such rights arise under applicable law or the agreed Booking Conditions.

Any refund or alternative arrangement will be assessed according to the specific circumstances and relevant legal requirements.

19. Passports, Visas, Travel Documents, and Local Regulations

Customers are responsible for ensuring they possess the travel documents legally required for their intended destination and activities.

These may include valid passports, visas, entry permits, identification documents, driving licences, certificates, or other authorisations.

Customers should consult the appropriate government or consular authorities for current entry requirements and travel advice.

Jukadi does not provide immigration or visa advice unless expressly stated for a particular service.

Unless otherwise required by law, Jukadi is not responsible for a Customer's inability to travel or participate because of missing, invalid, or insufficient personal documentation.

Where an Experience includes a specific permit or admission document, the listing should clearly explain whether it is included in the Booking price or must be obtained separately.

20. International Travel and Package Travel Regulations

Jukadi offers access to travel Experiences in multiple countries.

Local consumer protection, licensing, transportation, maritime, tourism, and safety regulations may apply to individual Experiences.

Jukadi and its Suppliers must comply with the legal obligations applicable to their respective activities.

Some combinations of travel services may qualify as package travel or otherwise fall within specialised travel legislation.

Where Jukadi acts as a package organiser, retailer, or another regulated participant under applicable law, the corresponding statutory obligations will apply.

These may include mandatory pre-contractual information, financial protection, responsibility for performance, cancellation rights, and other traveller protections.

Jukadi will not seek to avoid obligations imposed by package travel legislation merely by describing itself as an intermediary.

Where specialised statutory rights apply, those rights take priority over inconsistent provisions of these Terms.

A Customer should review any additional documentation provided for a regulated travel package before completing the purchase.

21. Supplier Conduct and Marketplace Standards

Suppliers must comply with Jukadi's applicable marketplace participation requirements and their separate supplier agreements.

Suppliers must provide accurate information and must not knowingly publish misleading descriptions, fabricated reviews, deceptive pricing, or unlawful offers.

Jukadi may investigate credible complaints concerning a Supplier's conduct.

Where reasonably justified, Jukadi may take action including requesting corrections, restricting listings, suspending bookings, withholding supplier settlements where contractually and legally permitted, or terminating the Supplier's marketplace access.

Any such action will be subject to applicable law and the relevant supplier agreement.

Jukadi may cooperate with payment providers, regulatory authorities, and law-enforcement agencies when legally required or reasonably appropriate.

The availability of these marketplace controls does not constitute a guarantee of any particular Supplier's performance.

22. Reviews, Ratings, and User Feedback

Customers may be permitted to submit ratings, reviews, photographs, and feedback relating to Experiences booked through the Platform.

Reviews must reflect genuine experiences and must not contain unlawful, fraudulent, defamatory, abusive, or deliberately misleading content.

Jukadi may implement verification, automated checks, and moderation procedures designed to reduce fraudulent or misleading reviews.

Suppliers must not purchase fabricated reviews, impersonate Customers, or improperly influence ratings.

Where reviews have been incentivised or sponsored, any legally required disclosures must be made.

Jukadi may remove or restrict content that violates applicable law, these Terms, or published moderation policies.

Moderation decisions will be made in accordance with applicable procedural and transparency obligations.

Reviews reflect the opinions of their authors and do not necessarily represent the views of Jukadi.

Jukadi does not guarantee that every published review is accurate or representative.

23. Search Results, Rankings, and Promotional Listings

Jukadi may organise and display Experiences using factors such as destination relevance, availability, pricing, customer feedback, popularity, booking activity, content quality, and other relevant criteria.

Search results and recommendations may vary according to user preferences, search terms, location selections, or Platform functionality.

Some Experiences may receive additional visibility as part of clearly identified promotional arrangements.

Where a listing or placement is sponsored or promoted, Jukadi will provide the disclosures required by applicable law.

The position of an Experience in search results should not be interpreted as a guarantee of superior quality, safety, or suitability.

Further information about applicable ranking and recommendation methods may be published in Jukadi's marketplace transparency documentation.

24. Intellectual Property and Website Content

Unless otherwise indicated, Jukadi owns or lawfully uses the intellectual property associated with the Platform, including its website design, branding, original editorial content, software interfaces, and other protected materials.

Third-party Suppliers and other rights holders may retain ownership of the photographs, trademarks, descriptions, and materials they submit.

Users may access and use Platform content for lawful personal purposes connected with researching or booking Experiences.

Users must not reproduce, scrape, distribute, commercially exploit, or otherwise misuse protected materials without authorisation or a valid legal basis.

Suppliers and Users submitting content to Jukadi confirm that they have the necessary rights and permissions to do so.

By submitting content for publication, the relevant rights holder grants Jukadi a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, translate, distribute, and use that content as reasonably necessary to operate, present, promote, and improve the Platform and the relevant Experiences.

This licence is limited by applicable law, privacy rights, and any additional written agreement between the parties.

Jukadi may remove content that infringes intellectual property rights or violates applicable law.

25. Prohibited Activities and Platform Security

Users must not engage in conduct that compromises the security, integrity, or lawful operation of the Platform.

Prohibited conduct includes:

  • Attempting unauthorised access to systems or accounts.

  • Uploading malicious software or harmful code.

  • Conducting fraudulent transactions.

  • Misusing another person's identity or payment information.

  • Manipulating Booking availability or payment procedures.

  • Publishing unlawful or deceptive content.

  • Circumventing reasonable technical security measures.

  • Using automated systems to extract protected content unlawfully.

  • Harassing other users or Suppliers.

  • Using the Platform for unlawful commercial activities.

Jukadi may take proportionate action to protect the Platform, including restricting access, cancelling fraudulent requests, and reporting unlawful activity to relevant authorities.

Such action will be subject to applicable laws and any legally required review procedures.

26. Personal Data and Privacy

Jukadi processes personal information in connection with account registration, bookings, customer support, payment facilitation, supplier communications, Platform security, and related business activities.

Personal data may be shared with the relevant Supplier where necessary to arrange or provide a booked Experience.

Other authorised service providers may process information on Jukadi's behalf or in another legally recognised capacity.

Jukadi's separate Privacy Policy explains the categories of information collected, relevant legal bases, purposes of processing, recipients, international transfers, retention practices, individual rights, and contact procedures.

Where applicable, Jukadi seeks to comply with the UK General Data Protection Regulation, the Data Protection Act 2018, and other relevant data protection requirements, including applicable European Union rules.

Customers should review the Privacy Policy before providing personal information.

Nothing in these Terms is intended to replace the separate privacy information and notices required under applicable data protection law.

27. Cookies and Third-Party Technologies

The Platform may use cookies and similar technologies to support essential functionality, security, language preferences, analytics, and other permitted purposes.

Non-essential cookies and tracking technologies will be used in accordance with applicable consent and privacy requirements.

Users should consult Jukadi's Cookie Policy for further information and available preference controls.

The Platform may integrate services provided by third parties, including payment processors, mapping providers, analytics services, security providers, and communication systems.

The operation of these technologies may be subject to additional notices and legal requirements.

28. Third-Party Websites and External Services

The Platform may include links to websites, booking resources, applications, or other services operated by third parties.

Such links are provided for convenience, reference, or functionality.

Unless expressly stated otherwise, Jukadi does not control external websites or their independent content, commercial policies, or privacy practices.

Customers should review the relevant terms before engaging with third-party websites.

Where Jukadi makes a specific representation, recommendation, or contractual commitment relating to a third-party service, its responsibility will be determined according to that representation, the circumstances, and applicable law.

Nothing in this section excludes liability arising from Jukadi's own legally actionable conduct.

29. Platform Availability and Technical Limitations

Jukadi seeks to maintain a functional and reasonably secure online marketplace.

However, uninterrupted access cannot be guaranteed.

The Platform may occasionally experience maintenance, software errors, network interruptions, cyber incidents, hosting failures, or other technical difficulties.

Jukadi may temporarily suspend or restrict access where reasonably necessary for maintenance, security, legal compliance, or operational reasons.

Where practicable, Jukadi will take reasonable steps to minimise disruption and restore affected services.

Jukadi does not guarantee that every Platform feature will remain available in every country or through every device.

Any liability arising from Platform failures will be assessed according to applicable law and the obligations owed by Jukadi.

30. Allocation and Limitation of Liability

Jukadi operates primarily as an intermediary marketplace connecting Customers with independent Suppliers.

Unless otherwise expressly agreed or required by applicable law, the relevant Supplier is responsible for the actual performance of an Experience.

Jukadi is responsible for performing its own contractual and statutory obligations with reasonable care and skill where required by law.

Jukadi will not automatically be responsible for an independent Supplier's acts or omissions solely because that Supplier advertises or receives Bookings through the Platform.

However, this does not exclude responsibility where Jukadi itself has breached a legal duty, made a legally actionable misrepresentation, acted negligently, or has obligations imposed by applicable law.

Jukadi does not accept liability for losses that are not attributable to its breach of duty or other legally actionable conduct.

To the extent permitted by applicable law, Jukadi is not responsible for losses arising exclusively from circumstances outside its reasonable control.

Jukadi is not responsible for losses attributable to the Customer's own unlawful conduct, serious breach of disclosed safety requirements, or failure to comply with reasonable instructions, except to the extent that Jukadi remains legally responsible.

For Customers acting in a consumer capacity, nothing in these Terms restricts remedies that cannot lawfully be limited or excluded.

In particular, nothing excludes or limits liability for:

  • Death or personal injury caused by negligence.

  • Fraud or fraudulent misrepresentation.

  • Any liability that cannot lawfully be excluded or restricted.

  • Mandatory consumer remedies or protections.

  • Statutory responsibilities arising under applicable package travel or other relevant legislation.

Nothing in these Terms requires a consumer to waive legal rights solely because they used the Platform or acknowledged the risks associated with an Experience.

Any liability limitation applicable to business users or Suppliers may be addressed separately in the relevant business agreement, subject to applicable law.

31. Indemnification and Responsibility for Misconduct

Users are responsible for their own unlawful acts and intentional misuse of the Platform.

Where permitted by applicable law, a User may be responsible for direct losses caused to Jukadi by the User's fraud, deliberate misconduct, infringement of third-party rights, or other legally actionable conduct.

This provision does not create an unlimited indemnity against consumer Customers or require them to compensate Jukadi for losses arising from Jukadi's own breach of duty.

Separate indemnification, insurance, and risk-allocation provisions may apply to professional Suppliers under their individual supplier agreements.

Nothing in this section reduces any mandatory consumer protection.

32. Complaints and Customer Support

Jukadi aims to provide a clear process for receiving and handling concerns about Bookings or Platform services.

Customers experiencing a problem with an Experience should notify the relevant Supplier and Jukadi as promptly as reasonably possible.

Where appropriate, the Supplier should be given a reasonable opportunity to address an operational problem while the Experience is taking place.

Customers may contact Jukadi at:

[email protected]

When submitting a complaint, Customers should provide relevant information, such as their Booking reference, the name of the Experience, the scheduled date, a description of the issue, and any supporting evidence.

Jukadi may request further information where reasonably necessary to investigate the complaint.

Jukadi may communicate with the Supplier, review available records, and assist in seeking an appropriate resolution.

Complaints will be assessed according to the applicable Booking Conditions, the respective responsibilities of the parties, and relevant law.

Customers are encouraged to report problems promptly. However, failure to complain within a suggested period does not automatically remove any statutory right or remedy.

33. Payment Disputes and Chargebacks

Customers should contact Jukadi where they believe a payment has been made incorrectly or a refund has not been administered appropriately.

Jukadi may review transaction records and communicate with payment service providers and Suppliers where necessary.

Customers retain their rights to contact their bank, payment card issuer, or relevant payment institution in accordance with applicable payment-services and consumer protection rules.

Jukadi may provide accurate transaction records and relevant evidence in response to a payment dispute or chargeback.

Customers must not knowingly submit fraudulent payment disputes or false claims.

Jukadi will not impose arbitrary penalties merely because a Customer exercises a lawful payment-dispute right.

Any action concerning a disputed payment will be proportionate and subject to applicable law.

34. Applicable Law and International Consumer Rights

These Terms and the contractual relationship between Jukadi and Users concerning the operation of the Platform are generally governed by the laws of England and Wales, subject to applicable conflict-of-law rules and mandatory legal protections.

The selection of English law does not deprive consumer Customers of mandatory rights that cannot lawfully be excluded under the law applicable to their circumstances.

Because Jukadi operates internationally, specific transactions may also be affected by the laws of the country where an Experience is performed, the Supplier is established, or the consumer is habitually resident.

The Supplier's contractual obligations relating to the performance of the Experience may be subject to the law applicable to the underlying service contract.

Nothing in these Terms prevents a consumer from bringing proceedings before a court or exercising a right to a remedy where such entitlement is protected by mandatory law.

Subject to those protections, disputes concerning Jukadi's own contractual obligations may be brought before the competent courts of England and Wales.

Where appropriate, Jukadi may seek to resolve disputes through good-faith negotiation, mediation, or other lawful dispute-resolution procedures.

Any voluntary dispute-resolution process will not remove the right to pursue legal remedies where applicable law protects that right.

35. Changes to These Terms

Jukadi may amend these Terms to reflect changes in applicable law, Platform functionality, operational procedures, business practices, or security requirements.

The updated version will be published on the Platform with a revised date.

Material changes affecting existing contractual rights will be communicated where required by law.

Updated Terms will generally apply to future use and future Bookings from their effective date.

Changes will not retrospectively remove rights or alter confirmed Booking obligations where doing so would be unlawful or inconsistent with the agreed contract.

Customers are encouraged to review the Terms periodically.

36. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable by a competent court or authority, that provision will be ineffective only to the extent required.

The remaining provisions will continue to apply where legally permissible.

Where appropriate, the affected provision will be interpreted consistently with applicable law without improperly expanding the rights or obligations of either party.

37. No Waiver

A failure or delay by Jukadi to exercise a contractual right does not automatically constitute a waiver of that right.

Any waiver must be valid under applicable law and does not necessarily apply to subsequent breaches or circumstances.

Nothing in this provision prevents a consumer from relying on any legal defence, remedy, or protection.

38. Assignment and Business Transfers

Jukadi may transfer or assign its rights or obligations in connection with a lawful corporate restructuring, sale, merger, or business transfer, where permitted by applicable law.

Any transfer must not unlawfully reduce the rights or protections available to Customers.

Where legally required, Customers will be notified or their consent obtained.

Customers may not transfer a Booking to another person without satisfying the applicable Supplier conditions and any mandatory legal requirements.

Any lawful right to transfer a regulated travel package or another transferable contract remains unaffected.

39. Entire Agreement and Order of Precedence

These Terms govern the general use of the Jukadi Platform.

Specific Bookings may additionally be governed by the Experience Conditions disclosed and accepted before purchase.

Supplier partnership agreements separately regulate the relationship between Jukadi and participating Suppliers.

Where a specific Booking Condition differs from a general provision of these Terms, the clearly disclosed and valid condition applicable to that Booking will govern the relevant service, subject to mandatory law.

Mandatory statutory rights always take precedence over inconsistent contractual terms.

A separate Privacy Policy and Cookie Policy govern the processing of personal information and the use of tracking technologies to the extent applicable.

Any separate cancellation or refund policy published by Jukadi must be interpreted consistently with these Terms and the specific Booking Conditions.

Where documents are materially inconsistent or ambiguous, the inconsistency will be resolved in accordance with applicable law, including any rule requiring an interpretation favourable to a consumer.

These Terms do not exclude legally binding pre-contractual information, express commitments, or other terms that must form part of the contract under applicable law.

40. Language and Translations

Jukadi may publish these Terms in multiple languages to assist Customers and Suppliers in different countries.

Translations are intended to communicate the same material rights and obligations as the English version.

Jukadi will seek to maintain accurate and consistent translations.

Where a discrepancy is identified, the parties should interpret the relevant provisions consistently with their intended meaning and applicable consumer law.

The English version may be used as a reference for resolving translation differences where legally permissible.

However, no language-precedence provision will override mandatory local language requirements, legally binding information provided to consumers, or consumer rights under applicable law.
