UK Marketplace Liability, Cancellation & Refund, and Data Protection Policy

Part One: Platform Liability Statement

1. Role of the Platform

Jukadi operates as a digital intermediary (online marketplace) that facilitates connections between users and independent travel service providers, tour operators, and activity organisers. Jukadi does not own, operate, or directly provide any of the tours, activities, or travel services listed on its platform unless explicitly stated otherwise.

By using the Jukadi platform, you acknowledge and agree that:

- Jukadi’s role is strictly limited to providing a technical interface for discovering, comparing, and booking services.

- The contractual relationship for any booked service exists solely between the user and the third-party service provider (supplier/operator).

2. Limitation of Liability

To the fullest extent permitted by the laws of England and Wales and applicable UK legislation, Jukadi shall not be held liable, whether in contract, tort (including negligence), or otherwise, for:

- The quality, safety, legality, or accuracy of any service provided by a third-party supplier.

- Any cancellation, rescheduling, modification, or no-show by the service provider.

- Any personal injury, property damage, financial loss, delay, or inconvenience arising from or related to the execution of a booked activity.

- Any discrepancy between the service description published on the platform and the actual experience delivered.

All services are delivered and managed independently by third-party providers. Jukadi does not supervise, control, or assume any operational responsibility for such services.

3. Supplier Responsibility

Each service provider (tour operator, activity organiser, or travel supplier) is fully and exclusively responsible for:

- Delivering the service as described in their listing, including adherence to any promised quality, duration, or inclusions.

- Complying with all applicable safety standards, licensing requirements, and legal regulations (including health and safety, insurance, and permits).

- Maintaining valid and adequate public liability and professional indemnity insurance.

- Ensuring the accuracy, completeness, and timeliness of all information related to their services, including pricing, availability, and terms.

Jukadi disclaims any responsibility for the acts, omissions, representations, or breaches of contract by any service provider.

4. User Responsibility

Users acknowledge and agree that they bear full responsibility for:

- Assessing whether the chosen activity is suitable for their physical, medical, and mental condition. This includes, without limitation, any pre-existing medical conditions, pregnancy, disabilities, or allergies.

- Reviewing all service details, terms, conditions, and safety warnings before completing a booking.

- Following all instructions, warnings, and safety protocols provided by the service provider during the activity.

- Providing accurate, complete, and truthful information during the booking process (including passport details, medical conditions, and emergency contacts).

Failure to comply with these responsibilities may result in denial of service, forfeiture of payment, and release of Jukadi from any associated liability.

5. Payments and Bookings

Payments may be processed through one of two channels:

- Directly via the Jukadi platform using a third-party payment processor; or

- Directly with the service provider outside the Jukadi environment.

In all cases:

- Jukadi is not a financial institution, payment services provider, or guarantor of any service.

- Any dispute arising from a payment (including overcharging, unauthorised transactions, or refund delays) must be resolved directly between the user and the service provider. Jukadi may, at its sole discretion, facilitate communication but assumes no adjudicative or compensatory role.

6. Content and Information Accuracy

Jukadi makes reasonable commercial efforts to ensure that all published information (including prices, descriptions, availability, and images) is accurate. However:

- Prices, availability, and service details are dynamic and may be updated by suppliers without prior notice.

- The platform does not guarantee that all content is free of human or technical errors, omissions, or temporary unavailability.

- Users are encouraged to verify critical information (e.g., pick-up times, inclusions) directly with the service provider before the activity date.

7. Third-Party Links and Integrations

The platform may contain links to external websites, embedded widgets, or integrations with third-party services (e.g., mapping tools, payment gateways). Jukadi is not responsible for:

- The content, privacy policies, or security practices of any external website.

- Any transactions, bookings, or data sharing conducted outside the official Jukadi platform.

- Any loss or damage arising from reliance on such third-party resources.

8. Force Majeure

Jukadi shall not be held liable for any delay, failure, or interruption in performance caused by circumstances beyond its reasonable control, including but not limited to:

- Natural disasters (earthquakes, floods, fires, storms, volcanic eruptions).

- Severe or hazardous weather conditions affecting travel or activities.

- Government actions, travel bans, lockdowns, border closures, or regulatory restrictions.

- Acts of terrorism, war, civil unrest, or public health emergencies (including pandemics and epidemics).

- Technical failures, cyberattacks, or outages of third-party infrastructure (internet, power, hosting).

In such events, Jukadi may, without liability, suspend platform operations or cancel pending bookings with appropriate notice.

9. Limitation of Legal Liability

To the maximum extent permitted by UK law:

- Jukadi’s total aggregate liability arising from or related to the use of the platform shall not exceed the total fees paid by the user to Jukadi for the specific booking giving rise to the claim, or £100 (whichever is lower).

- Jukadi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of opportunity, loss of data, or reputational harm.

- Any claims regarding the execution, quality, or safety of a booked service must be directed exclusively to the relevant service provider.

10. Updates to This Liability Statement

Jukadi reserves the right to update, modify, or replace this liability statement at any time. Changes become effective immediately upon posting on the platform. Continued use of the platform after any modification constitutes acceptance of the updated terms. Material changes will be notified to registered users via email or platform notification.

Part Two: Cancellation and Refund Policy

11. User-Initiated Cancellation

Standard cancellation tiers (apply unless otherwise stated in the specific service listing):

- More than 48 hours before the scheduled start time:

  The user is entitled to a full refund minus any non-refundable transaction fees (e.g., credit card processing fees, currency conversion charges).

- Between 48 hours and 24 hours before the scheduled start time:

  The user is entitled to a 50% refund of the total amount paid.

- Less than 24 hours before the scheduled start time, or failure to appear (no-show):

  No refund is due.

Exceptions: Certain activities (e.g., events requiring advance ticket purchases, permits for national parks, or exclusive charters) may have a stricter cancellation policy (e.g., non-refundable once booked). Such exceptions will be clearly displayed on the service listing page before booking.

12. Supplier-Initiated Cancellation

If a service provider cancels a confirmed booking for any reason other than force majeure, the user shall be entitled to:

- A full refund of all amounts paid (including any platform fees); or

- Rescheduling to an alternative date, subject to mutual agreement and availability.

Jukadi will use reasonable commercial efforts to facilitate the refund process. Jukadi does not charge additional fees for processing supplier-initiated cancellations.

13. Refund Processing

- Refunds are processed within **5 to 10 business days** from the date of cancellation confirmation.

- Refunds are issued using the original payment method (credit/debit card, PayPal, bank transfer).

- Jukadi is not responsible for delays caused by the user’s bank, payment card issuer, or payment processor.

14. Booking Modifications

- A user may request to modify the date or time of a booked activity at no additional charge, provided the request is submitted at least 24 hours before the original start time and the service provider confirms availability.

- Any request submitted less than 24 hours before the start time will be treated as a cancellation and may be subject to the standard cancellation penalties.

Part Three: UK GDPR Privacy and Data Protection Policy

15. Data We Collect

Jukadi collects and processes the following categories of personal data:

- Identity and contact data: Full name, email address, telephone number, postal address (if required).

- Booking data: Selected services, dates, times, group size, special requests (including dietary restrictions, accessibility needs, medical conditions where voluntarily disclosed).

- Transaction data: Payment card details (processed directly by a PCI-DSS compliant payment gateway; Jukadi does not store full card numbers), billing information, booking reference numbers.

- Technical data: IP address, browser type and version, device identifiers, operating system, referral URLs, and usage statistics collected via cookies and similar technologies.

- Communication data: Records of correspondence with Jukadi support, service providers, or other users.

16. Legal Basis for Processing (UK GDPR)

Jukadi processes your personal data on the following lawful bases:

- Contract performance: To manage bookings, process payments, and facilitate communication with service providers (Article 6(1)(b) UK GDPR).

- Legal obligation: To retain financial records for tax and accounting purposes (Article 6(1)(c) UK GDPR).

- Legitimate interests: To improve platform functionality, prevent fraud, analyse usage trends, and send service-related announcements (Article 6(1)(f) UK GDPR).

- Consent: For marketing communications, optional analytics cookies, and sharing sensitive data (e.g., medical conditions) where explicitly consented (Article 6(1)(a) and Article 9(2)(a) UK GDPR).

17. How We Use Your Data

Your personal data is used exclusively for:

- Confirming, managing, and communicating about bookings.

- Enabling service providers to prepare for and deliver their activities.

- Processing payments and issuing refunds.

- Responding to customer support inquiries and disputes.

- Detecting and preventing fraudulent or abusive activity.

- Complying with legal and regulatory obligations (including tax reporting).

- Sending marketing communications only where you have provided explicit consent (with an opt-out option in every message).

18. Data Sharing with Third Parties

Jukadi shares your personal data only with the following categories of recipients:

- Service providers (tour operators/activity organisers): To fulfil your booking. This includes sharing your name, contact details, special requests, and any medical information you voluntarily disclosed.

- Payment processors (Stripe, PayPal, or similar): To process transactions. These processors are independently compliant with PCI-DSS and UK data protection standards.

- Hosting and analytics providers (e.g., AWS, Google Analytics): To operate the platform and improve user experience, subject to data processing agreements.

- Legal and regulatory authorities: Only when required by law, court order, or lawful government request.

Jukadi does not sell, rent, or trade your personal data to any third party for marketing or advertising purposes.

19. Your Rights Under UK GDPR

As a data subject, you have the following enforceable rights:

- Right of access (Article 15): Request a copy of the personal data we hold about you.

- Right to rectification (Article 16): Correct inaccurate or incomplete data.

- Right to erasure (Article 17): Request deletion of your data (“right to be forgotten”), subject to statutory retention obligations (e.g., tax records for 6 years).

- Right to restriction of processing (Article 18): Limit how we use your data while a complaint is resolved.

- Technical logs (IP addresses, cookies): Retained for **12 months** for security and analytics purposes.

21. Data Security

Jukadi implements appropriate technical and organisational measures to protect your data, including:

- TLS 1.3 encryption (SSL) for all data transmitted between your browser and our servers.

- Pseudonymisation where feasible.

- Regular security audits and penetration testing.

- Restricted access to personal data on a need-to-know basis for authorised personnel only.

Despite these measures, no internet transmission is 100% secure. You transmit data at your own risk.

22. International Data Transfers

Your personal data may be transferred to and processed in countries outside the United Kingdom (including the European Union and the United States). Where such transfers occur, Jukadi ensures adequate safeguards are in place, including:

- UK-approved Standard Contractual Clauses (SCCs).

- Data processing agreements that reflect UK GDPR standards.

Jukadi uses the following categories of cookies:

- Strictly necessary: Required for platform operation (login, booking cart, security). No consent required.

- Marketing: Used only with explicit consent.

24. Children’s Privacy

Jukadi does not knowingly collect personal data from individuals under 18 years of age. If you believe a minor has provided data without parental consent, please contact us immediately for deletion.

Part Four: General Provisions

26. Governing Law and Dispute Resolution

This legal framework and any dispute arising from or relating to the use of the Jukadi platform shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute, claim, or controversy shall first be attempted to be resolved through good-faith negotiations. If unresolved within 30 days, either party may submit the dispute to binding arbitration administered by the Centre for Effective Dispute Resolution (CEDR) in London, unless the claim falls within the jurisdiction of the small claims court (value below £10,000).

27. Severability

If any provision of this legal framework is found to be unenforceable or invalid by a court or arbitration panel of competent jurisdiction, the remaining provisions shall remain in full force and effect.

28. Entire Agreement

This document constitutes the entire liability, cancellation, and privacy agreement between the user and Jukadi with respect to the subject matter herein, superseding any prior agreements or understandings, whether written or oral.
